Kano Boils Over Appeal Court Judgement, Ajadi, Others React

Kano, leading commercial town in the North is on the boil over contradicting Appeal Court judgement, and the police had to move in to disperse protesters.

The All Progressives Congress (APC) has however dismissed reported contradictions in the Certified True Copy (CTC) of the judgment which affirmed the judgment of the Kano State Governorship Election Petition Tribunal,.

By that, the tribunal had  declared its candidate, Dr. Nasiru Gawuna, as the winner of the governorship election.

The party’s National Legal Adviser, Prof. Abdulkareem Kana, said every lawyer knows that clerical errors are not strange with regard to such documents.

The Eagle reports that a chieftain of the New Nigeria People’s Party (NNPP), Ambassador Olufemi Ajadi Oguntoyinbo, has last Monday while reacting to the situation in Kano, had expressed concern over what he described as tending towards abuse of power.

Ajadi who spoke against the background of the ongoing travails of the Kano State governor Abba Yusuf, vis avis the case at the tribunal over the last gubernatorial election in the state, asserted  that the body language of the President Bola Ahmed Tinubu’s government indicated a determination to remove Abba Yusuf as Kano State’s governor.

The sentiment was to be echoed by NNPP South West Public Relations Officer, Mr. Kilamuwaye Badmus Bako, when both paid a solidarity visit to Abba Yusuf in Kano.

The tribunal had invalidated a significant number of Yusuf’s votes, while the Court of Appeal based its decision on his disqualification as an NNPP candidate during the election.

These has led to raised tempers in the state, putting security agencies on the alert.

Today, men of the police had to mobilsie and dispersed defiant protesters, aggrieved over the contradicting Appeal Court judgment.

The APC had dismissed concerns about the reported contradictions in the CTC of the judgment which affirmed the judgment of the Kano State Governorship Election Petition Tribunal, declaring its candidate, Dr. Nasiru Gawuna, as the winner of the governorship election.

The party’s National Legal Adviser, Prof. Abdulkareem Kana, had reportedly reacted to the developed.

“Those of us who are lawyers know that typographical errors often occur in certified true copies of court judgments.

“Ordinarily, this wouldn’t have been a confusion if it was probably not a political matter, because it will not be the first time such typographical mistakes will be seen in judgments and being lawyers we are used to a situation like this”, he was quoted in the Punch as saying.

“All that should be done is to merely correct that mistake. The most important thing is the judgment that was read in open court,” said Kana.

Meanwhile the Police in Kano has threatened it would clamp down on any group protesting in the state following the appeal court judgement and the sacking of the governor.

It will be recalled that last March, the Independent National Electoral Commission (INEC) declared Yusuf of the New Nigeria Peoples Party (NNPP) as the winner of the election, only for the state governorship election petitions tribunal to sack him in September.

Affirming that decision, the Court of Appeal held that Yusuf was not in the NNPP’s register, making him unqualified to contest the election. The court declared the All Progressives Congress (APC)’s Nasiru Gawuna as the winner of the poll.

The Appeal Court judgment is truly causing upheaval in the state.
