‘Criminal Litigation Against Trump Violates US Constitution’

How true is the assertion that the criminal litigation against President-elect of the United States, Donald Trump violates the country’s constitution?

That is one poser that the Georgia Appeals Court would have to be responding to.

The president-elect has, yesterday, asked a Georgia Appeals Court to end the criminal litigation against him, for attempting to overturn his 2020 election loss.

Speaking through his lawyers. Trump said a continued stay on the case by Fulton County District Attorney Fani Willis,  would violate the U.S constitution and would thus, not be in the interest of the state.

This comes even as many of his allies are also facing charges.

According to the lawyers, the president gets set to return to the White House next month. And the appeals court should remove Trump from the proceedings.

It should at the same time order a lower court judge to dismiss the case against Trump in its entirety.

The Eagle reports that Syracuse University law professor Gregory Germain, in an article of the school website last month posed the question: What Happens to the Pending Criminal and Civil Cases Against Trump Following His Election?” and then gone ahead to provide some answers, excerpted here for relevance:

A catalogue of criminal cases against Trump as compiled by Criminal Cases

1. Falsifying Business Records, New York Law. Trump has been convicted and is scheduled to be sentenced for a Class E felony for falsifying business records in the criminal case brought by Manhattan District Attorney Alvin Bragg, and pending before Judge Juan Merchan.
2. Election Interference, Georgia Law. Trump has been indicted in Georgia by District Attorney Fani Willis for election interference.
3. Classified Documents – Federal Law. Trump has been indicted by Special Counsel Jack Smith on federal charges for stealing, retaining, and making false statements about classified documents that he took from the White House after losing the 2020 election.
4. Election Interference – Federal Law. Trump has been indicted by Special Counsel Jack Smith for election interference in the 2020 election.

In the face of the above, can the above assertion that: ‘Criminal Litigation Against Trump Violates US Constitution’ hold water?
