How High Court Saved Ganduje, Family From Public Embarrassment

Yesterday, a Kano High Court saved former Kano governor, Dr Abdullahi Ganduje and his family from an impending public embarrassment and scandal.

Recall that Ganduje has subsisting issues with the Kano State Public Complaint and Anti-Corruption Commission (PCACC) and the Nigeria Police, regarding some of his conducts while the state’s helmsman.

Yesterday was supposed to be his pay day, and the agencies were set to rein the former number citizen in one of Nigeria’s most populous states, before a breather came.

It came in the form of an order from the Kano High Court, restraining the PCACC, the police force and other interested agencies from taking in the politician.

Not only that, the court also ruled that no family member or former appointee of the former governor should be arrested until a substantive originating motion concerning the governor was heard.

This followed a July 7, motion exparte filed by Ganduje’s counsel, Mr B Hemba, which cited  fundamental rights enforcement procedure rules 2009.

This is under section 46 of the 1999 Constitution of the Federal Republic of Nigeria as amended. There were many respondents in the suit and these included the Attorney General of the Federation, Attorney General of Kano State and Kano state Public Complaint and Anti-Corruption Commission.

Also respondents are the Nigeria Police, Inspector-General of Police, Commissioner of Police Kano State, State Security Services and Nigeria Security and Civil Defence Corps.

The applicant however prayed the court to stop the respondents from arresting him.

His request was granted by Justice A M Liman, and it restrains the respondents either by themselves or through a third party from harassing, intimidating or detaining Ganduje.

The order also covers his family members and those who work with him. That was how the High Court saved Ganduje and family members and employees from public embarrassment.
